Marketplace terms / version 2026-09-02-v1
The connection is ours. The deal is yours.
These terms are an agreement between you and Good Feels, Inc. for use of Fictional Goods. By submitting an introduction, you accept these terms for yourself and any organization you are authorized to represent. A placement, license, production order, or campaign requires a separate agreement between the brand and creator.
Eligibility and authority
You must be at least 18 and may submit only accurate information about yourself or an organization you are authorized to represent. An AI assistant may transmit information only after the represented person explicitly approves both the submission and these terms. You are responsible for activity performed through an assistant you authorize.
No account, acceptance, or exclusivity
Submission does not create an account, membership, agency relationship, exclusivity, promise of work, or obligation to negotiate. Fictional Goods may request verification, decline a fit, or close an incomplete introduction.
Marketplace role and responsibility
Fictional Goods operates an introduction and matching marketplace. It does not create, direct, edit, approve, manufacture, sell, publish, or distribute participant products or videos merely because it lists a profile, makes a match, or provides a structured deal-card workflow. Fictional Goods is not the brand, creator, producer, distributor, product seller, endorser, employer, talent agent, fiduciary, or a party to a brand-creator agreement unless a separate signed agreement expressly says otherwise.
The brand and creator choose whether to communicate, negotiate, contract, pay, produce, publish, or distribute. They are independently responsible for investigating each other and for their agreement, materials, claims, products, permissions, taxes, payment obligations, production, disclosures, platform compliance, distribution, and performance.
Participant promises
You promise that your submitted information is accurate, you control or have permission to share the submitted materials, and you will not use Fictional Goods to request unlawful, deceptive, infringing, undisclosed, or unsafe content. Each participant is responsible for substantiating product and audience claims, clearing intellectual-property and likeness rights, and following applicable advertising, sponsored-content, AI-content, product-safety, and platform rules.
Creator profiles
A creator profile is published only after the creator separately opts in and Fictional Goods accepts it for the roster. The creator grants Good Feels, Inc. a non-exclusive, worldwide, royalty-free license to display, format, and link the approved profile information solely to operate and promote the marketplace. The creator keeps ownership and may request correction or removal. A profile is creator-supplied information, not a guarantee or endorsement.
Direct agreements and marketplace fees
Brands and creators must document their own campaign terms, including compensation, payment timing, creative approvals, product claims, rights, usage, exclusivity, disclosure, delivery, and remedies. Fictional Goods may charge a brand a disclosed marketplace or workflow fee under separate written terms. Unless those separate terms say otherwise, Fictional Goods does not receive or hold participant compensation.
Indemnity for business use
If you use Fictional Goods for a business or organization, you agree, to the extent permitted by law, to defend, indemnify, and hold harmless Good Feels, Inc. and its personnel from third-party claims, losses, and reasonable costs arising from your materials, products, claims, rights violations, disclosures, contract performance, production, publication, or misuse of the marketplace. This does not apply to a claim caused by conduct for which Fictional Goods cannot lawfully disclaim responsibility.
Disclaimers and liability limits
The marketplace and participant-supplied information are provided “as is” and “as available.” Fictional Goods does not guarantee availability, identity, suitability, a match, campaign performance, audience results, revenue, legal compliance by another participant, payment, or uninterrupted access. To the fullest extent permitted by law, Good Feels, Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the marketplace or a participant transaction.
To the fullest extent permitted by law, Good Feels, Inc.’s aggregate liability arising from these site terms will not exceed the greater of US $100 or the marketplace fees you paid directly to Good Feels, Inc. during the twelve months before the event giving rise to the claim. Nothing in these terms excludes liability or a remedy that cannot legally be waived or limited.
Suspension and changes
Fictional Goods may reject, suspend, remove, or investigate a submission or profile that appears inaccurate, unsafe, abusive, infringing, or inconsistent with these terms. Material changes will be identified by a new version date and apply prospectively unless applicable law requires otherwise.
Governing terms and contact
These site terms are governed by the laws of Massachusetts, and disputes must be brought in its state or federal courts, without overriding rights or remedies that cannot legally be waived. These terms, the Privacy notice, and any separate signed Fictional Goods agreement are the complete terms between you and Fictional Goods for their respective subject matter. Questions may be emailed to hello@fictionalgoods.com or mailed to Good Feels, Inc., 23 Jayar Rd., Suite 6, Medway, MA 02053.
